Section 1031 of the Internal Revenue Code allows 100% of the gains from the disposition of business or investment property to be deferred into new “like kind” replacement property.To qualify for this deferral, strict adherence to the rules of Section 1031 is important. The transaction must be structured as an exchange as opposed to that of a sale.
